What’s changed?

These My Nintendo Rewards Program Terms of Service (the "Terms") apply to the My Nintendo Rewards Program. These Terms are a part of and incorporated by reference in the Nintendo Account User Agreement (the "Agreement").

NOTE: THE AGREEMENT CONTAINS A BINDING INDIVIDUAL ARBITRATION AND CLASS ACTION WAIVER PROVISION. THIS PROVISION, ALONG WITH ALL OTHER TERMS OF THE AGREEMENT, APPLY TO YOUR USE OF THE MY NINTENDO REWARDS PROGRAM.

By accepting the Agreement, you agree to be bound by these Terms. Additional terms and requirements may apply.

### About the My Nintendo Rewards Program

Welcome to the My Nintendo Rewards Program!

The My Nintendo Rewards Program (the "Rewards Program") is a loyalty program sponsored by Nintendo Co., Ltd. ("Nintendo," "we," or "our") that offers you the opportunity to earn points ("Points") that can be used to obtain digital content and other rewards ("Rewards"). You can find additional information regarding the Rewards Program on the "My Nintendo" website (the "Website").

You must have a Nintendo Account in order to participate in the Rewards Program. If you do not have a Nintendo Account, please visit Nintendo.com for information on how to create one. You will be automatically enrolled in the Rewards Program and begin earning Points as soon as you create your Nintendo Account.

These Terms only apply to participants with a Nintendo Account country of residence setting located within the Americas. If your country of residence is located outside this region, please check the Website to find the terms of service applicable to you.

### Earning Points

The Rewards Program gives you the opportunity to earn both "Platinum Points" and "Gold Points".

#### Platinum Points

Except as otherwise determined by Nintendo, Platinum Points may be earned by completing certain activities made available to you by Nintendo from time to time ("Missions"). Please refer to the Website for instructions on how to complete each Mission and the number of Platinum Points associated with each Mission.

Some Missions may involve activities associated with the use of a Nintendo Network ID. Such activities must be performed using a Nintendo Network ID linked to your Nintendo Account.

Progress on one Mission cannot be applied toward a different Mission, even if the activities involved are similar. Partial Platinum Points cannot be earned for incomplete Missions.

#### Gold Points

As of March 24, 2025 you will no longer be able to earn Gold Points. Except as otherwise determined by Nintendo, Gold Points may still be earned by registering selected physical games released on or prior to March 24, 2025.

Please refer to the Website for more information on the number of Gold Points that may be available with your purchase and the deadline by which you must register your physical games to claim your Gold Points.

Some exclusions apply, and not all physical games qualify for Gold Points.

### Rewards: Redeeming Your Points

Points may be redeemed for certain Rewards, as described in more detail on the Website.

Some Rewards can be obtained multiple times, while others can be obtained only once. Supply may be limited and, in such cases, Reward availability may be on a first-come, first-served basis.

Rewards are nonrefundable. Rewards are personal to you and cannot be shared, copied, or transferred. Rewards are promotional, have no cash value, and cannot be redeemed for cash or its equivalent. When you redeem Rewards for digital content through a Nintendo application or Nintendo’s eShop, the user agreement associated with those services will apply to your use of such digital content. Please refer to the Website for information on the value of Gold Points when redeemed toward the purchase of eligible Nintendo goods and services.

Platinum Points earned within an application on an iOS device cannot be redeemed in the same application on an Android device, and vice versa. All Points are redeemable on the Website, regardless of the operating system on which they were earned.

### Restrictions

Points will automatically be used in the order in which you received them. Platinum Points **will expire after 6 months and Gold Points will expire after 12 months** . If you or we delete your Nintendo Account, if your Nintendo Account or linked Nintendo Network ID is suspended or banned, or if all or a portion of the Rewards Program is terminated or discontinued for any reason, your earned Points will become invalid and unusable.

Points are not your personal property. Points are promotional and have no cash value, are nonrefundable, and cannot be redeemed for cash or its equivalent. Any unused or expired Points will not be returned to you unless required by law. You may not combine your Points with any other Nintendo Account, or transfer or sell your Points to anyone for any reason. Any attempt to combine or transfer Points will result in the forfeiture of all earned Points. You may not create multiple Nintendo Accounts in order to increase your chances of earning Points. Gold Points can only be used in countries using the same currency as the country in which they were earned. If you change the country setting associated with your Nintendo Account, your Gold Points will remain in your Nintendo Account, but they will not be displayed in countries where they cannot be used.

You are responsible for ensuring the accuracy of your Points balances, and we encourage you to check your balances regularly. If you believe that Points were not properly accrued to your balance, please contact customer service within 7 days of the Points award date. If a Mission requires that you actively collect Platinum Points, you will lose any Points that you do not collect within 30 days from the date that such Points are issued.

We reserve the right to determine and interpret the terms regarding how Points are earned, issued, and administered, and our decisions are final and binding. Points that we determine to be invalid for any reason may be removed from your Nintendo Account.

### General

All or a portion of the Rewards Program, including the availability and type of Points, Rewards, and Missions, may vary by country and may not be available everywhere and to all users. Nintendo reserves the right to shorten, extend, modify, suspend, terminate, or cancel the Rewards Program at its discretion, at any time, even though these changes may affect your ability to accrue or use Points. Modifications may include, but are not limited to, the methods by which you can earn Points, the value of Points, the number of Points, the type and number of Missions, the type and availability of Rewards, and any of the options that we make available through the Rewards Program.

Your failure to comply with these Terms may result in your disqualification from the Rewards Program and the suspension, deletion or ban of your Nintendo Account.

In order to obtain certain Rewards or accept certain Missions, you may need to have a Nintendo video game system(s) and/or game(s). Additional purchase(s) may be required. Any system requirements will be described in the applicable Mission or Reward description.

You are responsible for the payment of taxes or any other costs, if any, which may result from participation in the Rewards Program.

Changes that we make to these Terms or the Rewards Program will be effective immediately upon posting on the Website, and you waive any right you may have to receive specific notice of such changes. Your continued participation in the Rewards Program constitutes your acceptance of any changes to these Terms. You are responsible for remaining knowledgeable as to any changes that we make to these Terms. If you do not agree to the Terms, you must stop participating in the Rewards Program by deleting your Nintendo Account.
